Membership Agreement, Waiver and Release of Liability, Assumption of Risk, Photo/Media Release, and Privacy Acknowledgement

This Agreement applies to all FlowBall USA membership activities from the date of submission until it is revoked, replaced, or updated by FlowBall USA in writing.The participant, or the participant’s parent or legal guardian if the participant is under 18 years old, agrees to promptly notify FlowBall USA of any material changes to the participant’s health information, contact information, guardianship status, or other information relevant to safe participation in FlowBall USA activities. In consideration for being accepted as a member of FlowBall USA and/or being permitted to participate in any class, program, workshop, training, practice, demonstration, performance, competition, community event, volunteer activity, or related FlowBall, Rouliqiu, Tai Chi-inspired, wellness, fitness, youth sports, adult fitness, senior wellness, or recreational activity organized, sponsored, or conducted by FlowBall USA, I acknowledge and agree as follows:
 

1. Membership Acknowledgement

I understand that membership in FlowBall USA may provide access to selected member benefits, including but not limited to class updates, event information, educational resources, free lessons, community activities, volunteer opportunities, member communications, and other programs offered by FlowBall USA. I understand that membership does not guarantee participation in every class, event, performance, competition, workshop, or program. Some activities may require separate registration, approval, payment, eligibility, age requirement, skill level, health condition review, or space availability. I agree to provide accurate and complete information during registration and to update FlowBall USA if any relevant information changes.
 

2. Assumption of Risk

I understand that participation in FlowBall, Rouliqiu, Tai Chi-inspired movement, fitness, wellness, recreational, performance, and related activities involves inherent and other risks. These risks may include but are not limited to falls, collisions, muscle strain, joint discomfort, overexertion, contact with other participants, coaches, volunteers, spectators, equipment, balls, rackets, unsafe surface or facility conditions, weather-related risks, transportation-related risks, illness, exposure to communicable or infectious diseases, and other risks that may result in bodily injury, emotional distress, property damage, permanent disability, paralysis, or death. If the participant is 18 years or older, I knowingly and voluntarily assume all such risks on my own behalf. If the participant is under 18 years old, I knowingly and voluntarily assume all such risks on behalf of myself and the minor participant, whether known or unknown, to the fullest extent permitted by California law.
 

3. Health Acknowledgement

I represent that the participant is physically and mentally able to participate in the selected activities, or that I have otherwise determined that participation is appropriate. I understand that it is my responsibility to inform FlowBall USA of any allergies, medical conditions, injuries, illnesses, communicable or infectious diseases, restrictions, disabilities, special needs, or other conditions that may be relevant to safe participation or emergency response. I understand that FlowBall USA is not a medical provider and is not responsible for diagnosing, monitoring, or treating any medical condition. I agree that the participant should stop participation immediately if feeling pain, dizziness, shortness of breath, unusual discomfort, illness, or any unsafe condition.
 

4. Compliance with Rules / Removal from Activity

I agree that the participant and, if applicable, the participant’s parent or legal guardian will follow all rules, instructions, safety requirements, class policies, facility rules, and program guidelines established by FlowBall USA and its owners, directors, officers, employees, volunteers, coaches, trainers, contractors, agents, and representatives. I understand that FlowBall USA reserves the right to suspend or remove any member or participant whose conduct is unsafe, disruptive, inappropriate, disrespectful, harmful to others, or inconsistent with program rules, community standards, or safety requirements.
 

5. Release and Waiver of Liability

On behalf of myself and, if applicable, the minor participant, and our respective heirs, assigns, personal representatives, and next of kin, I hereby release, waive, discharge, and agree not to sue FlowBall USA and its current and former owners, directors, officers, employees, volunteers, coaches, trainers, contractors, agents, representatives, sponsors, event partners, affiliated entities, facility providers, and the owners and operators of premises used for the activities, collectively the “Released Parties,” from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind arising out of or relating to membership, participation in activities, use of equipment, presence at facilities, or travel to and from activities, to the fullest extent permitted by California law. This release includes claims based on the ordinary negligence of the Released Parties, but does not apply to conduct that cannot be released under California law.
 

6. Indemnity and Hold Harmless

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or relating to membership, participation in activities, the participant’s acts or omissions, or my own acts or omissions in connection with the activities, except to the extent prohibited by California law.
 

7. Medical Authorization and Responsibility for Expenses

I understand that FlowBall USA does not provide health, medical, or accident insurance for members or participants. I agree that I am solely responsible for any and all medical, dental, hospital, ambulance, rehabilitation, or related expenses arising from membership or participation in FlowBall USA activities. In the event of injury, illness, or other emergency, I authorize FlowBall USA and its representatives to obtain reasonable emergency medical care for the participant if I or the participant’s primary contact cannot be reached immediately. I understand and agree that I am solely responsible for all resulting costs.
 

8. Photo and Media Release

I grant FlowBall USA and its designees the irrevocable right and permission to photograph, video record, audio record, livestream, reproduce, edit, publish, display, distribute, and otherwise use the participant’s and/or my image, likeness, voice, appearance, name, performance, participation, and activity-related materials in connection with FlowBall USA activities, in whole or in part, in any medium now known or later developed, for any lawful purpose, including but not limited to educational, promotional, informational, archival, website, social media, press, and community outreach purposes, without further notice or compensation. I understand that such materials may be used in print, online, and digital media and may be viewed or accessed by third parties. I waive any right to inspect or approve the final use of such materials. I release and discharge the Released Parties from any claim arising out of or related to the use of such images, recordings, or materials, including claims for defamation, invasion of privacy, right of publicity, or emotional distress, to the fullest extent permitted by California law.
 

9. Additional Acknowledgement for Minor Participants

If the participant is under 18 years old, I represent that I am the participant’s parent or legal guardian and that I have the legal authority to sign this Agreement on the participant’s behalf. I further understand and agree that I am permitting the minor participant to join FlowBall USA and participate in activities, consenting to all terms of this Agreement on behalf of myself and the minor participant, assuming all risks associated with the minor participant’s participation, and accepting full responsibility for the minor participant’s conduct, safety, medical needs, and expenses arising from membership or participation in activities.
 

10. Parent / Guardian or Accompanying Adult Presence

If I am a parent, legal guardian, or accompanying adult and choose to be present at, observe, attend, accompany, wait at, move around, volunteer, assist, or otherwise remain on or near the premises or facilities where the activities take place, whether or not I participate in any activity or use any equipment, I acknowledge that I am doing so voluntarily and at my own risk. On behalf of myself and my heirs, assigns, personal representatives, and next of kin, I knowingly and voluntarily assume all risks arising out of or related to my own presence, observation, attendance, accompaniment, movement about the premises, participation, volunteering, assistance, or use of equipment, and I hereby release, waive, discharge, and agree not to sue the Released Parties for any and all claims arising out of or relating to the same, to the fullest extent permitted by California law.
 

11. Membership Communications

I agree that FlowBall USA may contact me by email, phone, text message, messaging apps, or other reasonable communication methods for purposes related to membership, class updates, event notices, safety information, volunteer opportunities, community programs, payment reminders, member benefits, and other FlowBall USA-related communications. I understand that I may request to stop receiving non-essential promotional communications, but FlowBall USA may still contact me regarding safety, registration, payment, emergency, membership, or activity-related matters.
 

12. Privacy Acknowledgement

All personal information collected through this form will be used solely for FlowBall USA membership registration, communication, program administration, participant safety, emergency response, class organization, event management, volunteer coordination, and related purposes. Such information will not be shared externally without consent, except as required by law or as reasonably necessary for emergency response, safety, insurance, payment processing, facility administration, event operation, or program management.
 

13. No Representations; Voluntary Agreement

I acknowledge that no oral statements or representations have been made to me to alter the meaning or effect of this Agreement. I understand that this is a legally binding document. I have read it carefully, understand its contents, and agree to it freely and voluntarily.
 

14. Governing Law / Severability

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

FlowBall USA 柔力球会员加入协议、责任豁免与免责、风险承担、照片/媒体授权及隐私确认

本协议自提交之日起适用于 FlowBall USA 的所有会员相关活动，直至被 FlowBall USA 以书面形式撤销、替换或更新为止。如参与者未满18周岁，则由其父母或法定监护人签署；如参与者已满18周岁，则由参与者本人签署。参与者本人或其父母/法定监护人同意，在参与者的健康信息、联系信息、监护关系或其他与安全参加 FlowBall USA 活动相关的重要信息发生重大变化时，及时通知 FlowBall USA。鉴于本人申请成为 FlowBall USA 柔力球会员，和/或获准参加由 FlowBall USA 组织、主办或开展的任何课程、项目、工作坊、训练、练习、展示、表演、比赛、社区活动、志愿者活动，或其他与柔力球、FlowBall、Rouliqiu、太极启发类运动、健康运动、健身、青少年体育、成人健身、长者健康或休闲活动相关的内容，本人确认并同意如下：
 

1. 会员确认

本人理解，加入 FlowBall USA 柔力球会员项目后，可能获得部分会员权益，包括但不限于课程更新、活动信息、教学资源、免费课程、社区活动、志愿者机会、会员通知，以及 FlowBall USA 提供的其他项目。本人理解，成为会员并不保证可以参加所有课程、活动、表演、比赛、工作坊或项目。部分活动可能需要单独报名、审核、付费、符合资格、年龄要求、技术水平、健康条件或名额限制。本人同意在注册时提供真实、准确、完整的信息，并在相关信息发生变化时及时通知 FlowBall USA。
 

2. 风险承担

本人理解，参加柔力球、FlowBall、Rouliqiu、太极启发类运动、健身、健康运动、休闲活动、表演及相关活动本身具有固有风险及其他风险。该等风险包括但不限于跌倒、碰撞、肌肉拉伤、关节不适、过度用力、与其他参与者、教练、志愿者、观众、器材、球、球拍发生接触、不安全的地面或场地条件、天气相关风险、交通相关风险、疾病、接触传染性或感染性疾病，以及其他可能导致人身伤害、精神痛苦、财产损失、永久残疾、瘫痪或死亡的风险。如参与者已满18周岁，本人知情并自愿自行承担上述所有风险。如参与者未满18周岁，本人知情并自愿代表本人及该未成年参与者承担上述所有风险，无论该等风险是否已知，并在加利福尼亚州法律允许的最大范围内承担该等风险。
 

3. 健康确认

本人声明，参与者在身体和精神上适合参加所选择的活动，或者本人已自行作出其适合参加活动的判断。本人理解，本人有责任告知 FlowBall USA 任何可能与安全参与活动或紧急应对相关的过敏、健康状况、受伤、疾病、传染性或感染性疾病、限制条件、残障、特殊需求或其他情况。本人理解，FlowBall USA 不是医疗服务提供者，不负责对任何健康状况进行诊断、监测或治疗。本人同意，如参与者出现疼痛、头晕、呼吸困难、异常不适、疾病或任何不安全状况，应立即停止参与活动。
 

4. 遵守规则 / 退出活动

本人同意，参与者及其父母或法定监护人（如适用）将遵守 FlowBall USA 及其所有人、董事、高管、员工、志愿者、教练、训练人员、承包商、代理人和代表所制定的所有规则、指示、安全要求、课程规定、场地规则及项目指南。本人理解，若任何会员或参与者的行为不安全、扰乱秩序、不适当、不尊重他人、对他人造成伤害，或不符合项目规则、社区标准或安全要求，FlowBall USA 有权暂停或取消其参与资格。
 

5. 责任豁免与免责

本人谨代表本人，以及未成年参与者（如适用），并代表我们各自的继承人、受让人、个人代表及近亲属，在加利福尼亚州法律允许的最大范围内，特此免除、放弃、解除并同意不起诉 FlowBall USA 以及其现任和前任所有人、董事、高管、员工、志愿者、教练、训练人员、承包商、代理人、代表、赞助商、活动合作方、关联实体、场地提供方以及活动场地的所有人和经营方（以下统称“被免责方”）因会员身份、参加活动、使用器材、在场地内停留或往返活动途中而产生或与之相关的任何及所有索赔、请求、诉因、损害、损失、责任、费用或支出。本免责条款包括基于被免责方一般过失提出的索赔，但不适用于根据加利福尼亚州法律不得免责的行为。
 

6. 赔偿与免责保障

本人同意，在加利福尼亚州法律未禁止的范围内，就因会员身份、参加活动、参与者的作为或不作为，或本人就活动相关的作为或不作为而引起或与之相关的任何及所有索赔、责任、损害、损失、费用或支出，包括合理律师费，对被免责方予以赔偿、抗辩并使其免责。
 

7. 医疗授权及费用承担

本人理解，FlowBall USA 不为会员或参与者提供健康保险、医疗保险或意外保险。本人同意，因会员身份或参加 FlowBall USA 活动而产生的任何及所有医疗、牙科、住院、救护车、康复或相关费用，均由本人自行承担。如发生受伤、疾病或其他紧急情况，且 FlowBall USA 无法立即联系到本人或参与者的主要联系人，本人授权 FlowBall USA 及其代表为参与者寻求合理的紧急医疗救助。本人理解并同意，由此产生的一切费用均由本人自行承担。
 

8. 照片与媒体授权

本人授予 FlowBall USA 及其指定方不可撤销的权利和许可，可就 FlowBall USA 相关活动对参与者和/或本人进行拍照、录像、录音、直播、复制、编辑、发布、展示、传播及以其他方式使用参与者和/或本人的形象、肖像、声音、外貌、姓名、表演、参与过程及活动相关材料。该等材料无论整体或部分，无论以现有或未来开发的任何媒介形式，均可为任何合法目的使用，包括但不限于教育、宣传、信息发布、存档、网站、社交媒体、新闻媒体及社区推广用途，且无需另行通知或支付报酬。本人理解，该等材料可能用于纸质、网络及数字媒体，并可能被第三方查看或接触。本人放弃审查或批准该等材料最终使用方式的任何权利。本人在加利福尼亚州法律允许的最大范围内，免除并解除被免责方因使用该等图片、录音、录像或材料而产生或与之相关的任何索赔，包括诽谤、侵犯隐私、公开权或精神损害方面的索赔。
 

9. 未成年参与者附加确认

如参与者未满18周岁，本人声明，本人系该参与者的父母或法定监护人，并具有代表其签署本协议的合法权限。本人进一步理解并同意：本人允许该未成年参与者加入 FlowBall USA 并参加相关活动；代表本人及该未成年参与者同意本协议全部条款；承担与该未成年参与者参加活动有关的所有风险；并对该未成年参与者因会员身份或参加活动而产生的行为、安全、医疗需求及相关费用承担全部责任。
 

10. 家长 / 监护人或陪同成年人在场确认

如本人系家长、法定监护人或陪同成年人，并选择在活动场地或设施内或附近到场、观看、陪同、等候、走动、担任志愿者、协助活动或以其他方式停留，无论本人是否参与任何活动或使用任何器材，本人确认该等行为完全出于自愿，且风险由本人自行承担。本人谨代表本人及本人的继承人、受让人、个人代表及近亲属，自愿知情地承担因本人在场、观看、陪同、到场、在场地内走动、参与活动、担任志愿者、协助活动或使用器材而产生或与之相关的所有风险，并在加利福尼亚州法律允许的最大范围内，免除、放弃、解除并同意不起诉被免责方就此产生或与之相关的任何及所有索赔。
 

11. 会员通知与沟通

本人同意，FlowBall USA 可以通过电子邮件、电话、短信、通讯软件或其他合理方式与本人联系，用于会员相关事项、课程更新、活动通知、安全信息、志愿者机会、社区项目、付款提醒、会员权益及 FlowBall USA 相关沟通。本人理解，本人可以要求停止接收非必要的宣传类信息，但 FlowBall USA 仍可就安全、报名、付款、紧急情况、会员身份或活动相关事项与本人联系。
 

12. 隐私确认

通过本表单收集的个人信息仅用于 FlowBall USA 的会员注册、沟通联系、项目管理、参与者安全保障、紧急处理、课程组织、活动管理、志愿者协调及相关用途。除法律要求，或为紧急处理、安全保障、保险、付款处理、场地管理、活动执行或项目管理所合理必需外，未经同意不会对外共享该等信息。
 

13. 无其他陈述；自愿同意

本人确认，任何人均未向本人作出任何口头陈述或说明，以改变本协议的含义或法律效果。本人理解，本协议具有法律约束力。本人已仔细阅读本协议，理解其内容，并系自由、自愿地同意本协议。
 

14. 适用法律 / 可分割性

本协议受加利福尼亚州法律管辖并依其解释。如本协议任何条款被认定为无效或不可执行，其余条款仍应继续保持完全效力。
